About the Role
Nature of position: Permanent, Full Time
Location: Melbourne, VIC
Reporting Line: Head of Commercial – Utilities
Key Responsibilities
The role is charged with supporting the maximisation of financial return (in the form of EBITDA) for the Utilities Division, by ensuring that projects are executed in accordance with Service Stream’s governance and risk management frameworks.
Pre-Contract Award
Provide commercial input to the assessment and development of new business pursuit strategies
Review contractual instruments and apply Service Stream’s risk profile to evaluate opportunity suitability
Coordinate and lead opportunity and risk assessments
Model and analysis commercial frameworks, applying sensitivity analysis to forecast contractual performance
Identify risk mitigation strategies and develop opportunity capitalisation plans
Prepare commercial tender responses
Participate in the governance and assurance review process
Lead commercial negotiations and collaborate with legal teams to finalise contractual instruments
Post Contract Award
Provide commercial input into rights and obligations handover to project delivery teams
Facilitate structured handover of contract, subcontracts and project control tools to project delivery teams
Support contract risk control and assurance activities through commercial reporting and audit reviews
Lead margin and contract performance reviews
Respond to project team escalations concerning contract interpretation or commercial performance queries
Support contractual dispute process escalations
Support management of contractual disputes including interfacing with internal and external legal counsel
Governance
Champion implementation of structured commercial management practices across the Utilities Division
Support embedment of Service Stream project controls, risk management, and compliance frameworks
Respond to queries pertaining to delegated authorities, procurement, and contract interpretation
Collate and manage commercial reporting data and analysis
About You
Tertiary qualification in law and business/commerce
Minimum 3-years’ experience in a similar role
Knowledge of and direct exposure to tier one contractor risk and governance frameworks
Direct exposure to broad contracting models and model contract terms
Utilities and power generation sector knowledge
Preparation of executive and board level reports, briefs and memorandums of advice
Competencies required:
Autonomous contract review and risk assessment
Drafting and interpretation of contractual terms, and associated contractual correspondence and notices
Construction project financial modelling, analysis and reporting
Contractual claims analysis and management
Preparation of discovery dossiers and legal brief
